(male announcer) this is the bay area news station. kron 4 news starts now. >> catherine: new tonight at 8 - the investigation into the discovery of a woman's body in a stairwell at san francisco general. kron 4's justine waldman has new information on what lynne spalding was wearing when her body was found --- two and a half weeks after she was reported missing. >> "this is not just negligence. this is gross negligence." >> reporter: the attorney for lynne spalding's family tells kron 4 news. the 57-year old mother of two. was not wearing a hospital gown when officials found her body. he shared with me new information he just learned from sf general. about what spalding was wearing when officials discovered her in the stairwell. >> "that she was dressed in her own clothes and her purse was near her body." >> reporter: attorney haig harris says. she also left some personal belongings behind >> "her cell phone left in

her room. it was on her bed with a sheet or blanket over it." >> reporter: missing posters the family put up near the hospital say she was last seen wearing blue jeans, black boots and a black sweatshirt. with the words "san embroidered on it. it is unclear now if that is what she was wearing at the time of her death. it is clear to harris, spalding never left the hospital alive. >> "everything that i have heard so far and logic tells you lynne spalding was there. the entire time she was missing? i think so." >> reporter: the family is also shocked someone wearing a name tag at the hospitalmight have seen her suffering in the stairwell and told a senior staff member. >> "he said words to the effect. there is a person lying between the 3rd and 4th floors." >> reporter: harris questions if the sheriff's office ever did a complete searchafter the hospital made 4 different requests to help locate her. >> "i don't know where they looked, but i can't believe if they searched the stairwell that they

wouldn't have found this woman. >> reporter: mr. harris expects to hear from the sheriff's office this week. about when searches for lynne took place. and where they happened. he is hoping to speak with sheriff ross mirkarimi directly. >> catherine: how are lynne's children doing? >> reporter: she has a teenaged son and daughter. the lawyer told me. the son is devestated. and the daughter. in his mind. is feeling guilty that she brought her mother to sf general.and she didn't come back. there are still a lot of questions. >> catherine: thank you , justin waldman. the investigation continues tonight into a possible case of elderly abuse in castro valley. authorities say that numerous patients may have been abandoned when their care facility closed down last week. those patients have since

been moved to other locations. kron 4's charles clifford is live in alameda county with an update. charles, do we know where the these people have been moved to? >> reporter: this facility remains closed and we believe that all of the patients have been taken to local hospitals. over the weekend, the alameda county sheriff's deparment says they removed 14 residents from the valley springs manner care facility because as of last thursday, the facility's operating license had been temporarily suspended by the state. the sheriffs department also said the patients were not being properly cared for and that the 3 person staff was overwhelmed. >> how could somebody do that? these are human lives. >> reporter: on monday afternoon, i spoke on the phone with an attorney representing the owners of valley springs. he says that they were in the process of finding all of the residents new places to stay. he claims that last week the owners had moved 16 people to new locations and that last weekend only 11.. not

14... patients remained here at valley springs the attorney also says they were still trying to find those remaining residents places to live and that the appropriate number of employees, 2 caregivers and a cook, were left to manage the facility over the weekend. are >> there are still a lot of questions. and with the state inland local levels in the attorney i spoke with. the owners are appealing the suspension of the operating license. in castro valley, charles clifford, kron 4 news. >> catherine: this is the photo of the woman accused of driving drunk and hitting and killing two pedestrians in menlo park friday. 54-year-old marjorie reitzell, of redwood city, is charged with two felony counts of manslaughter and two counts of driving under the influence. she's still getting medical care - and was not in court for her arraignment today. prosecutors say her blood- alcohol level was more than twice the legal limit.

what turned out to be a replica ak-47. several agencies are investigating - including the f.b.i. community leaders are planning a march tomorrow in santa rosa to demand more information. >> a 3-alarm fire in san francisco's mission district damaged four buildings and forced evacuations today. it broke out today in a 2- story building on valencia street. the fire spread to other buildings - including a pilates studio. because the buildings are so closely packed together here, when firefighters arrived -- the fire was upgraded to three alarms almost immediately. they called a three alarm. >> we had approximately 100 fire fighters on scene here. they were able to prevent it from spreading any further than the buildings on either side and the one behind it >> catherine: no one was injured.but half a dozen people had to be evacuated from the buildings. crews put the fire out around 2 pm.

>> windy weather did some major damage in the bay area overnight. this is a home in danville -- now red-tagged as unsafe after a huge redwood came crashing down on the roof sunday. the tree also took out a fence on the side of the house. and in antioch. a close call. the wind brought down a huge tree in the backyard of a home on 6th street landing on top of a bedroom. a man inside was scratched by the tree branch. he says if he'd been sitting just a directionthe branch would have landed right on top of him. so what can we expect for tomorrow? kron 4 chief meteorologist jacqueline bennett is live in our weather center. tracking the conditions. jacqueline? >> jacqueline: catherine, it is going to be calmer we can see the peak when the gusting readings. with the

scott rates? >> reporter: this is exciting. and who really cold but it is gorgeous. it is such a cool thing. and quite cool. and you can see the big chunks of snowfall right off the ground. take a look at some video. when i first got appear at 5,000 ft.. the snow started at 3,500 ft. as i was driving along interstate 80. along the donner pass. these roadways, they are very icy. and you want to be very careful. and there are some areas were the c h p is requiring tire chain laws in effect. but it is gorgeous and still pretty to look at.

warning.as cases steadily climb in the u-s. the centers for disease control is urging parents to get your kids vaccinated for the flu, even if they're otherwise healthy. a new report found that nearly half of kids who died from flu complications had no other medical conditions or risk factors for complications. researchers say about 830 children died from flu- related complications between 2004 and 2012. the c-d-c says children should start getting yearly flu shots at six months old. and google's flu tracker indicates cases have been on the rise the past couple of months. their map shows people are searching for flu information at moderate levels in several southern states.from florida to new mexico. illinois, minnesota all moderate.nevada also moderate. california.and the majority of states have low flu activity.

>> new tonight at 8-- shock and outrage tonight in colombia. after the arrest of a 45- year-old colombian mother. charged with prostituting her daughters. authorities say she began selling them to men as soon as they turned 12. rafael romo reports. >> reporter: did you force your daughters into prostitution, a reporter asked. >> "no, my darling," the woman answered through tears. >> reporter: margarita zapata is a 45-year-old mother of 14 who police say did the unthinkable - selling the virginity of 12 daughters. it was one of those daughters who reported the woman to colombian police. the girl is now 16, but

police say her mother sold her to a man when she was 12. two years later she gave birth to a son. >> "as soon as her daughters turned 12 years old, this mother contacted men of means so that they would go to her house and there, for anywhere between 160 and 210 dollars, she gave them her daughters so that they would have sex with them. she would offer their virginity." >> reporter: a 51-year-old man was also arrested along with zapata. police say he fathered the baby boy with the girl who reported her mother to authorities. a girl who's now with a colombian child protection agency. >> (voice of translator) "this is a crime that according to colombian law is classified as rape of a 14-year-old. that's what the man faces. the woman, this mother, is facing charges of sexual exploitation and sexual trafficking for profit." >> reporter: at the catalina neighborhood in bogota, where the suspect and her children lived, residents expressed their disgust.
